Kementerian Agama Issues New Regulations for Marriage Ceremonies Outside KUA and on Weekdays
In a recent development, the Ministry of Religious Affairs has issued new regulations regarding marriage registration. Couples can now hold their marriage ceremonies outside the Office of Religious Affairs (KUA) or on weekdays, expanding their options for tying the knot.
The regulation is outlined in Minister of Religious Affairs Regulation No. 30 of 2024 concerning Marriage Registration. This regulation was signed by Minister Nasaruddin Umar on December 24, 2024. According to Article 16(1) of Regulation No. 30 of 2024, marriages can still take place at the KUA during office hours.
However, the significant change allows marriages to also be conducted outside the KUA or outside regular office hours. This flexibility comes with certain conditions outlined in Article 16(2) of the regulation. These conditions include a request from the prospective bride and groom (catin) and approval from the Head of the KUA/Marriage Registrar.
With the introduction of this new regulation, the previous Minister of Religious Affairs Regulation No. 22 of 2024 concerning Marriage Registration is no longer valid. Previously, Article 16 of Regulation No. 22 of 2024 stipulated two main points:
1) Marriages must take place at the District KUA during office hours.
2) Marriages as mentioned in point (1) can be conducted outside the District KUA.
As the new regulation comes into effect, Article 59 of Regulation No. 30 of 2024 states that the previous Minister of Religious Affairs Regulation No. 22 of 2024 regarding Marriage Registration is repealed.
Furthermore, Article 60 specifies that this new regulation will be effective from the date of enactment, which was December 30, 2024.
